These Terms of Purchase apply to all purchases of goods and services from our website at www.movewithturia.com
("Website").
Please read these Terms of Purchase carefully. By purchasing or using any of our programs, products or services, you agree to follow the terms stated herein, and an agreement ("Agreement") is entered into between you, the purchaser ("You"), and the owner and operator of this Website, the seller of the relevant program, product or service being purchased ("Product"), The Trustee for Pitt Hoskin Trust, trading as Turia Pitt International (ABN 61 952 639 684) ("Turia").
All references to “we”, “our” or “us” shall be construed to mean Turia.
If the user is not an individual, then “You” means your company or organisation.
These Terms of Purchase should be read in conjunction with Turia’s Privacy Policy, any terms and conditions applicable to any Product that you purchase (as notified by us), and all other applicable documents.
PRODUCTS
Turia offers a range of digital products and services which may include, but are not limited to:
• online training programs
• fitness courses
• memberships
• coaching programs
• challenges
• digital downloads
• educational materials and resources
The specific Product you purchase will be identified in your online shopping cart at the time of purchase.
Turia agrees to provide the Product identified in your purchase confirmation, subject to availability.
You agree to abide by all policies and procedures outlined in this Agreement as a condition of and in consideration of your purchase of the Product.
ACCESS TO DIGITAL PRODUCTS
Unless otherwise specified at the time of purchase, access to digital Products begins on the date access is granted to you.
Different Products may provide access for different durations, which may include:
• fixed duration programs
• on-demand programs
• limited-time access
• ongoing or lifetime access
• subscription or membership access
Details of the access period applicable to your Product will be provided at the time of purchase.
Turia reserves the right to modify delivery platforms or program formats where reasonably necessary, provided access to purchased Products continues for the applicable access period.
DIGITAL DOWNLOADS
Certain Products may include downloadable materials such as training plans, guides, templates or other digital resources.
These materials are provided for personal use only.
You may not reproduce, redistribute, resell, share, or otherwise distribute these materials without the express written consent of Turia.
FEES
The fee for the Product will be as stated on our Website or as otherwise indicated to you at the time of purchase.
All fees for our Products are listed in Australian Dollars (AUD) unless otherwise stated.
METHODS OF PAYMENT
By making a purchase, you authorise us to charge your credit card, debit card, or other payment method via an online third-party payment provider.
The terms and conditions of that payment provider apply separately to this Agreement and you should familiarise yourself with those terms before making a purchase.
PAYMENT PLANS
Where a payment plan is offered and selected, you authorise us to charge your nominated payment method at the intervals set out during the purchase process.
You agree that:
• instalment payments will be deducted automatically from the authorised payment method on a date anchored to your date of purchase
• sufficient funds must be available on the authorised payment method to meet instalment payments
• if a payment attempt fails, we may make further attempts to process payment at our discretion
Payment plans may be cancelled or refused if, including but not limited to:
• fraudulent behaviour is suspected
• funds are not available on the agreed payment dates
In the event of a failed payment or cancelled payment plan, Turia reserves the right to immediately revoke access to the Product and any associated services, including access to community groups or program platforms.
SUBSCRIPTION PRODUCTS
Some Products may be offered as subscriptions or memberships.
Where this applies:
• billing will occur at the interval specified during purchase
• subscriptions may renew automatically unless cancelled
• cancellation must occur prior to the next billing cycle to avoid additional charges
Access to subscription Products may be suspended or terminated if payment fails or the subscription is cancelled.
REFUND POLICY
Turia wants you to be satisfied with your purchase.
Certain Products may include a trial or refund period as specified on the Product page.
For programs offering a four-week trial period, you may request a refund within four weeks of the program start date by contacting our support team at [email protected]
.
Subject to law, refunds will not be provided for change of mind requests made after the applicable refund period.
For other digital Products, refunds may not be available once access has been granted, except where required under Australian Consumer Law.
If a refund is granted, access to the Product will be removed and any outstanding instalments under a payment plan will be cancelled.
ACCOUNT USE
Access to Products is provided for individual use only.
You agree not to:
• share login credentials
• allow other people to access your account
• distribute program content
• reproduce or redistribute any Product materials
Turia reserves the right to suspend or terminate accounts that are found to be sharing access or misusing the platform.
CONFIDENTIALITY
Turia respects your privacy and expects that you respect the privacy and confidentiality of Turia and other program participants.
Any information shared by participants or representatives of Turia including personal details, program materials, or business information shall be considered confidential and may only be used for the purpose for which it was provided.
The parties agree not to disclose, reveal or make use of any confidential information unless required by law or permitted in writing.
INTELLECTUAL PROPERTY
All material provided as part of any Product remains the intellectual property of Turia or its related entities.
This includes, but is not limited to:
• videos
• training plans
• written materials
• guides
• graphics
• branding
• teaching aids and program content
These materials are provided solely for your personal use.
You may not sell, reproduce, share, record, distribute, teach, or otherwise make these materials available to third parties without the express written consent of Turia.
CLIENT RESPONSIBILITY AND HEALTH DISCLAIMER
Turia’s programs are intended for general educational and fitness purposes only.
By participating in any program, you acknowledge that:
• physical exercise involves inherent risks
• you participate voluntarily and at your own risk
• you are responsible for consulting a medical professional if you have any health concerns before participating
Turia makes no guarantees regarding individual results.
Results may vary between participants depending on a range of personal factors.
INDEPENDENT CONTRACTOR STATUS
Nothing in this Agreement creates a partnership, joint venture, employment relationship, or agency relationship between the parties.
Each party remains an independent contractor.
FORCE MAJEURE
Turia shall not be liable for delays or failure to perform obligations due to events beyond our reasonable control including acts of God, pandemics, natural disasters, labour disputes, government restrictions, or technical failures.
LIMITATION OF LIABILITY
To the extent permitted by law, you agree that all use of Turia’s Products is at your own risk.
Turia will not be liable for any direct, indirect, incidental, consequential, or special damages arising from the use of our Products or participation in our programs.
Where liability cannot be excluded under Australian law, Turia’s liability is limited to the extent permitted by law to:
• supplying the services again; or
• payment of the cost of having the services supplied again.
Nothing in these Terms limits rights under Australian Consumer Law.
TERMINATION
Turia may terminate or suspend access to any Product if you breach these Terms or if your conduct is offensive, abusive, or disruptive to other participants.
