Participant Liability Waiver and Release

1. Participation and Acknowledgement of Risk
   Run With Turia offers structured physical activity programs and general guidance through its representatives, including coaches and fitness consultants (the “Organisers”).
   
   You acknowledge that participation in any Run With Turia program, including but not limited to online training programs, coaching, or related activities (the “Activities”), involves physical exertion and carries inherent risks, including but not limited to injury, aggravation of existing conditions, illness, or in extreme cases, death.
   
   You acknowledge that you voluntarily choose to participate in the Activities with full knowledge and acceptance of these risks.
   
   You understand that while the Activities are designed to be safe and supportive, not all exercises are suitable for all individuals.

 

2. Medical Acknowledgement
   Turia recommends that you consult with your doctor or qualified healthcare professional before beginning the Activities or any exercise program. You acknowledge that you are solely responsible for determining whether you are medically fit to participate in the Activities.
   
   You agree that:

• You are physically fit and able to participate in the Activities
• You have not been advised otherwise by a medical professional
• You are not aware of any condition that would prevent safe participation
  
  If you experience pain, discomfort, dizziness, or any unusual symptoms during exercise, you agree to stop immediately and seek medical advice.
  
  You further agree:

• Not to force or strain your body beyond its limits
• To modify or skip exercises where necessary
• To take full responsibility for monitoring your own condition

3. Participant Responsibilities
   You agree to:

• Follow all reasonable instructions and guidelines provided by the Organisers
• Participate in a safe and responsible manner
• Refrain from consuming drugs or alcohol immediately before or during the Activities
  
  You acknowledge that the Activities are drug and alcohol free.

 

4. Release and Waiver of Liability
   To the extent permitted by law, you release Turia and its related bodies corporate, officers, directors, employees, contractors, agents, and representatives from any and all claims, demands, actions, or causes of action of any kind and howsoever caused (including by negligence), arising out of or in connection with your participation in the Activities.
   
   This includes, without limitation:

• Personal injury
• Death
• Loss or damage to property
• Aggravation of existing medical conditions
  
  You acknowledge that you participate in the Activities at your own risk.
  
  Nothing in this Waiver excludes, restricts, or modifies any rights you may have under the Competition and Consumer Act 2010 (Cth) or any other applicable consumer protection laws.

 

5. No in person supervision
   You acknowledge that Run With Turia does not organise, host or supervise any in-person events, meetups, group runs or gatherings.
   
   You understand that any in-person interaction with other participants is entirely voluntary, informal, and undertaken at my own risk.
   
   You agree that I am solely responsible for my own safety and wellbeing during any such activities, and I release and discharge Run With Turia from any liability arising from or in connection with any in-person interaction with other participants.

6. Indemnity
   You agree to indemnify and hold harmless Turia and its related entities, officers, employees, contractors, and agents from and against any liability, claims, or proceedings arising from:

• Your negligence
• Your failure to follow reasonable instructions
• Your breach of this Waiver

 

6. Third Parties
   You acknowledge that Turia is not responsible for any other individuals who may be present with you or participate alongside you unless they have independently agreed to this Waiver.

 

7. Severability
   If any provision of this Waiver is found to be invalid or unenforceable, that provision will be severed and the remaining provisions will continue in full force and effect.

 

8. Governing Law
   This Waiver is governed by the laws of New South Wales, Australia. You agree to submit to the exclusive jurisdiction of the courts of New South Wales and the Federal Court of Australia.

 

9. Acceptance
   By proceeding with your purchase and participating in the Activities, you confirm that:

• You have read and understood this Waiver & Risk Acknowledgement
• You voluntarily agree to be bound by its terms
• You accept full responsibility for your participation.
